A group of state-subsidized home health care workers is asking a federal judge to halt a vote that could unionize thousands who provide in-home care to the elderly or disabled.


U.S. District Judge Michael Davis is expected to rule Wednesday.


Nine home-care workers claim a 2013 law that allows personal care attendants to unionize is unconstitutional because it violates their right of free political expression and association.


They want it blocked, and they immediately want to stop an election to determine if nearly 27,000 home-care providers will be represented by the Service Employees International Union. Ballots went out Aug. 1 and will be tallied Tuesday.


Attorneys for the state and union oppose the injunction, saying providers won't be required to join the union, or pay dues if they don't join.
